For Photography Workshops, Tours, and Expeditions


Limitation of Liability

Adam Schallau dba Adam Schallau Photography does not accept liability for any loss or additional expense caused by the cancelation of the workshop, photo tour, or expedition (programs) or delay or interruption to travel services. Such losses or additional expenses are the responsibility of the passenger/participant.

Adam Schallau Photography and any instructors or assistants are not liable for injury, accident, or theft resulting from participation in our programs. It is the participant’s responsibility to obtain information about any risks involved. Participant signature on the Acknowledgment of Risk form at the time of registration verifies the release of liability of the Adam Schallau Photography, staff, guest instructors, volunteer trip leaders, and any contractors. Any questions about program content, requirements, or risks may be directed to our office prior to the time of registration.


Force Majeure

For purposes of the terms & conditions described in this document, Force Majeure shall mean a cause or event such as; war or the threat of war, protests, riots, terrorist activity, civil strife, governmental acts, industrial disputes, labor strikes, injunctions, natural disasters, nuclear disaster, fire, wildfire, plague, epidemic, pandemic, outbreaks of infectious disease or any other public health crisis, including quarantine or other employee restrictions, or unfavorable or adverse weather conditions that are not reasonably foreseeable or otherwise caused by or under the control of Adam Schallau Photography. Any delay or failure in the performance by Adam Schallau Photography shall be excused if and to the extent caused by the occurrence of a Force Majeure.


Pricing & Payment

Program registrations are accepted on a first-come, first-served basis. All program pricing is in U.S. dollars. All fees may be paid with a credit card (via PayPal or Stripe) or check. All fees stated are for program tuition only and do not include airfares, transportation, meals, film and processing, or guide or instructor gratuities unless otherwise noted.

A non-refundable deposit, the amount will be specified in the program information, is required at the time of your registration. Reservations for programs cannot be held without a deposit. Unless otherwise noted, the balance of the program fee is due no later than 90 days before the program start date. Should this final payment fail to process or be received by the date specified, we reserve the right to treat the reservation as canceled and retain the deposit. If a reservation is made 90 days or less before the program start date, then the full amount is payable at the time of reservation.


Withdrawal & Refund Policy

All program withdrawal requests by the program participant must be in writing and received either by US mail or e-mail and acknowledged by Adam Schallau Photography. There are NO EXCEPTIONS TO THIS POLICY, even for medical emergencies. Payments made for private workshops or tours and river trips are not refundable regardless of when you cancel.

Based on the cancelation date, the following apply:

• Greater than 91 days before the program start date: refund of the program fee, less the program deposit.

• Within 90 days of the start of the program: no refund.

No matter when you cancel, if we can fill your space, we will refund any payments made minus a 15% processing fee.


Cancelation Policy

Adam Schallau Photography reserves the right to alter or cancel any program for any reason. In the unlikely event that we need to cancel a program, we will refund all monies paid in full, or you have the option of receiving a credit in the amount of the program fee that may be applied in full to pay for a future program to be used within 24 months of the original program you are registered to participate in. Adam Schallau Photography cannot be responsible for any travel expenses or non-refundable purchases, deposits, or reservations. It is recommended that you purchase trip insurance.

Notification of cancelation will be made via either a telephone call or an e-mail to you. We cannot be responsible for voicemail messages and e-mails not being received in a timely matter due to your service provider(s).


Travel Insurance

It is highly recommended you purchase travel insurance for your program and travel expenses. Many travel insurance providers offer products that do more than protect the money you invest in your trip — they protect you in unforeseen circumstances. We suggest a plan which offers coverage for medical and dental emergencies, lost baggage, missed connections, and trip cancelation should you have a medical problem that prevents you from attending. Adam Schallau Photography is not responsible for cancelations due to medical emergencies or for reimbursement of non-refundable airline tickets in case of a program cancelation.

Many of our clients have purchased travel insurance through Travelex Insurance Services.


Not Included

Air transportation and related fees (except as indicated in the itinerary); activities noted as optional in the itinerary; gratuities, unless otherwise noted on the itinerary page; passport and visa expenses; baggage/accident/cancelation insurance; personal expenses, such as laundry, telephone calls, meals (except as indicated on the itinerary) alcoholic beverages; and any other items not explicitly noted as included. Transportation and National Park entrance fees are not included in your program unless otherwise specified or agreed upon in writing.


Lodging

Private Tours & Workshops: The fee for private tours & workshops does not cover the cost of lodging. Please make your reservations as early as possible to ensure you have acceptable accommodations during your visit.

Group Workshops: The workshops listed on this website include private, single-occupancy lodging unless otherwise noted.

Cost increases for lodging may occur unexpectedly due to rising costs of accommodations, among others.


Equipment

Adam Schallau Photography does not provide equipment of any kind for use by program participants. Program participants must provide their own photography gear and (if needed) a laptop computer.


Itinerary Flexibility

The type of programs we offer requires flexibility and must allow for alternatives. For this reason, the program description must be taken as an indication of what may occur and not as a contractual obligation.


Instructor Substitution

In the event of the specified instructor being unable to attend due to illness or other circumstances beyond our control, another instructor will be provided if possible. If we need to replace an instructor, we will do so with someone of equal or similar credentials and will inform you if at all possible.


Participant Delineation and Limitation

Non-Instructive Role: You acknowledge and agree that your role as an attendee of the program is limited to that of a program participant, equivalent to all other non-instructor program participants. Our programs are intended to foster a collaborative learning environment, and to that extent, you can participate in the same manner as other non-instructor program participants in generalized discussions about photography knowledge, photography experience, photography equipment, photography conditions, and compositions. However, you acknowledge and agree that you shall not serve, act, or imply you are an instructor of the program. To that end, as a program participant, you shall not provide any lessons, instructions, tutorials, formal critiques, or any other activity/conduct that would suggest or imply to the other program participants that you are an instructor of the program.

Business Solicitation Prohibited:
Our programs are intended to foster a collaborative learning environment rather than serve as a platform for commercial promotion. Participants in our programs are strictly prohibited from engaging in any form of business solicitation during the program sessions. To that end, you acknowledge and agree that you shall not promote your own commercial photography services, photography tours, photography workshops, photography instructional activities, or photography business. Further, you agree that you shall not distribute business cards or other promotional materials. You agree that you shall refrain during the program from actively seeking clients for your current or future photography business.

Intellectual Property:
All program materials, including but not limited to instructional materials, handouts, maps, and any other proprietary information provided during the workshops, are the exclusive intellectual property of the program organizers. Participants are strictly prohibited from reproducing, distributing, or sharing these materials without prior written consent from the program organizers. You acknowledge and agree that you shall not reproduce, distribute, or share the program organizers’ said protected intellectual property program materials without express written permission of the program organizers.


Participant Health & Physical Fitness

Adam Schallau Photography photographic programs are within the abilities of average people in good health. We ask that you please contact us if you have any questions or concerns about the activity levels of the programs. Some programs require the ability to walk or hike a few miles over uneven trails while also carrying your photo gear, and most of the programs are at a high elevation. By reserving a space in a program with a deposit, you certify that you do not knowingly have any physical or other conditions of disability that would create a risk for you or other program participants or program staff. Once your program payment has been made, medical circumstances will not be considered as exceptions to our cancelation policy. We assume no responsibility for medical care or special dietary requirements.


Use of Name & Likeness

We reserve the right to take photographs or videos during the operation of any program or part thereof and to use the resulting photography in whole or in part for promotional purposes, including, but not limited to: advertising and publicity both in print and electronic media. By booking a reservation with Adam Schallau Photography, participants agree to allow their images to be used in such photography; participants who prefer that their image not be used are asked to identify themselves to their tour leader at the commencement of their trip. We also reserve the right to use, in all or in part, any written reviews you may provide to us in our advertising and publicity, both in print and electronic media.


Substance-Free Environment

The possession and use of alcohol and illegal drugs and the use of smoking and e-cigarette and other vapor products are prohibited in any of the classrooms, meal areas, or rooms used by Adam Schallau Photography or at any field program location.


Modifications to Terms and Conditions

Adam Schallau Photography reserves the right to modify or amend these terms and conditions at any time. Any changes will be effective immediately upon posting the updated terms and conditions on our website. It is your responsibility to review the terms and conditions periodically to stay informed about any updates.


Acceptance of Terms & Conditions

By enrolling in our photography workshops, tours, or expeditions, you acknowledge that you have read, understood, and agreed to abide by these terms and conditions. Failure to comply with these terms may result in removal from the workshop and other legal remedies as deemed necessary.
